Breastfeeding: The new law and how it affects your company

The Patient Protection and Affordable Care Act (H.R. 3590) was signed into law in March 2010. Among many provisions, Section 4207 of the law amends the Fair Labor Standards Act of 1938 to require an employer to provide reasonable break time and a private place, other than a bathroom, for one year each time the breastfeeding (non-exempt) employee wishes to express milk. Further, these requirements shall not preempt a state law that provides greater protections to employees.

Written policies help ensure compliance with legal mandates and help to avoid misunderstandings or confusion. A written Lactation Support Policy should minimally include:

  • Statement of official position of support for breastfeeding in the workplace
  • Background information on benefits of breastfeeding
  • Background information on legal mandates to support and accommodate breastfeeding in the workplace
  • List of all possible breastfeeding accommodations
  • Information about flexible break time for breastfeeding or expressing milk
  • Description of acceptable/available facilities for breastfeeding or expressing milk
  • Description of all employer sponsored lactation education/support or services
  • Information about who will be responsible for coordinating worksite lactation services and overseeing compliance with written policies
  • Anti- harassment/discrimination statement
