Breastfeeding: The new law and how it affects your company

"Savvy employers have realized that support for breastfeeding does much more than simply meet legal mandates, it is proven to reduce healthcare costs."

The Patient Protection and Affordable Care Act (H.R. 3590) was signed into law in March 2010. Among many provisions, Section 4207 of the law amends the Fair Labor Standards Act of 1938 to require an employer to provide reasonable break time and a private place, other than a bathroom, for one year each time the breastfeeding (non-exempt) employee wishes to express milk. Further, these requirements shall not preempt a state law that provides greater protections to employees.

Savvy employers have realized that support for breastfeeding does much more than simply meet legal mandates. Providing accommodations for breastfeeding offers tremendous rewards for the employer. Workplace Lactation Programs are proven to positively impact the bottom-line, enhance the work environment and improve public image. Specifically, companies that support breastfeeding report:

  • Cost savings of up to $4.50 per $1 invested
  • Reduced absenteeism to care for ill children
  • Lower health care costs for both breastfed children and mothers that breastfeed
  • Improved employee productivity
  • Higher employee morale and greater loyalty
  • Improved ability to attract prospective employees
  • Greater retention of valuable employees
  • Enhanced reputation as an industry leader and innovator
  • Positive image to the consumer and community

Creating a Breastfeeding Friendly Work Environment - Getting Started

The first step for employers is to create a written Lactation Support Policy. Having written policies benefits both the employer and the working mother. Written policies help ensure compliance with legal mandates and help to avoid misunderstandings or confusion. A written Lactation Support Policy should minimally include:

  • Statement of official position of support for breastfeeding in the workplace
  • Background information on benefits of breastfeeding
  • Background information on legal mandates to support and accommodate breastfeeding in the workplace
  • List of all possible breastfeeding accommodations
  • Information about flexible break time for breastfeeding or expressing milk
  • Description of acceptable/available facilities for breastfeeding or expressing milk
  • Description of all employer sponsored lactation education/support or services
  • Information about who will be responsible for coordinating worksite lactation services and overseeing compliance with written policies
  • Anti- harassment/discrimination statement
